The Campus Security Enhancement Act of 2008 and JCAR Administrative Rules

On June 5, 2009, the Joint Committee on Administrative Rules (JCAR) finalized the campus security-related rules package proposed by the Illinois Emergency Management Agency (IEMA) entitled “All Hazards Campus Emergency Plan and Violence Prevention Plan.”  IEMA developed the rules pursuant to The Campus Security Enhancement Act of 2008 (P.A. 95-881).  According to JCAR, a number of provisions that were mandatory in the proposed version of the rules, but were not required by statute, have been made advisory in the final version.  In a number of instances throughout the rules the word “shall,” which signifies a mandatory action, has been changed to “should,” which indicates a recommended or advisory action.  For details regarding requirements and recommendations of the Campus Security Enhancement Act of 2008 and the Administrative Rules see the links below.

As recommended by rule, institutions’ emergency plans should be reviewed by the institution’s local Emergency Services Disaster Agency (ESDA) and upon completion should be submitted to the Illinois Board of Higher Education (IBHE) at: Illinois Board of Higher Education, Campus Emergency Plans, 431 East Adams, 2nd Floor, Springfield, IL 62701-1404. Community Colleges should submit a copy of their completed plans to the Illinois Community College Board (ICCB) at: Illinois Community College Board, Campus Emergency Plans, 401 E. Capitol Ave., Springfield, IL 62701-1711.
