Distance Education Exemption for Out-of-State Institutions

To evaluate whether your out-of-state institution qualifies for a limited physical presence in the state of Illinois, please complete the Distance Education Application Form. Note the application will need to be printed, signed by the appropriate administrator (campus president or compliance officer), and mailed to the Illinois Board of Higher Education for processing and review. There is a $250 fee required. Send the $250 payment via check, money order, or cashier check and mail with the signed form to:

Once the completed form is received and fee is deposited, the request will be reviewed and a written determination will be rendered. Decisions about whether an institution qualifies for an exemption cannot be conducted over the phone or email. Please follow the process outlined for assistance.

The relevant 23 Illinois Administrative Code 1030.10 (c)(2)(A-D) for the Distance Education Exemption is Private Administrative Rules. Institutions participating in the State Authorization Reciprocity Agreement (SARA) do not need to apply for the exemption.
